Terms of Use for CustomWheelers

Please read these terms carefully before using our services. They govern the legal relationship between you and CustomWheelers.

  1. Scope and Subject Matter of the Contract

    These Terms of Use apply to the use of the website customwheelers.com and all associated services, in particular the consultation and execution of individual vehicle modifications. CustomWheelers offers services for optimizing vehicles in terms of functionality and personal style.

    By using our website or commissioning a service, you expressly accept these terms. Deviating terms of the user shall not apply unless we have agreed to them in writing.

  2. Scope of Services and Obligations of CustomWheelers

    CustomWheelers provides services in the field of vehicle modification based on individual customer requests. The exact scope of services will be recorded in writing in a separate offer or contract.

    We undertake to perform the agreed services with due care and in accordance with the current state of the art. All information on the website regarding possible modifications is to be understood as non-binding descriptions and does not constitute guaranteed characteristics.

    • The consultation includes an analysis of customer needs and the presentation of possible solutions.
    • The modifications are carried out in our workshops or at authorized partners.
    • CustomWheelers reserves the right to provide partial or advance services if this is in the customer's interest.
  3. User Obligations

    The user is obliged to provide all information necessary for the performance of the service truthfully and completely. This includes in particular details about the vehicle, desired modifications, and any previous owners or prior damage.

    The user assures that they are authorized to carry out the modifications (e.g., owner of the vehicle or authorized representative). In the event of violations of this obligation, the user shall be liable for all resulting damages.

    Duty to Cooperate

    The user is obliged to make the vehicle available at the agreed time and to present the required documents (vehicle registration document, certificate of registration). Delays caused by the user may result in additional costs.

  4. Remuneration and Payment Terms

    The remuneration for our services is derived from the respective offer or contract. All prices are in Euros (EUR) and include statutory value-added tax unless otherwise stated.

    Payment shall be made in accordance with the agreed payment terms, usually in advance or upon invoicing within 14 days. In the event of late payment, we are entitled to demand default interest at a rate of 5 percentage points above the base interest rate.

    • Down payments may be agreed for extensive projects.
    • Refunds in the event of early termination depend on the progress of the services rendered.
    • CustomWheelers is entitled to assign outstanding claims to a collection agency.
  5. Liability and Warranty

    CustomWheelers shall be liable for damages caused by intentional or grossly negligent behavior of our legal representatives or vicarious agents to the full extent. In the case of simple negligence, we shall only be liable for the breach of essential contractual obligations (cardinal obligations), limited to the typically foreseeable damage.

    The warranty for defects in the service is 12 months from acceptance. The user is obliged to report obvious defects in writing within 14 days of acceptance. For hidden defects, the reporting period begins upon discovery.

    Exclusion of Liability

    CustomWheelers assumes no liability for damages arising from improper use of the vehicle after modification, force majeure, or interference by third parties. Liability for data loss or damage is excluded insofar as the user has not ensured adequate data backup.

  6. Contract Duration and Termination

    The contract for an individual service ends with the complete performance of the service and payment of the remuneration. For framework agreements or continuing obligations, the minimum term is 12 months unless otherwise agreed.

    The right to extraordinary termination for good cause remains unaffected. A good cause exists in particular if the user violates essential contractual obligations or if it becomes impossible for CustomWheelers to perform the service.

    • Termination requires written form.
    • In the event of termination by the user before performance of the service, we are entitled to demand a compensation of 15% of the agreed price.
  7. Data Protection and Confidentiality

    CustomWheelers processes the user's personal data exclusively for the fulfillment of the contract and on the basis of applicable data protection laws. Please refer to our privacy policy at policy.html for details.

    The user undertakes not to disclose any confidential information received in the course of the collaboration (e.g., technical drawings, price lists) to third parties and to use it only for the agreed purpose.

  8. Changes to the Terms of Use

    CustomWheelers reserves the right to change these Terms of Use at any time with effect for the future. We will inform the user of material changes by email or by a notice on the website.

    If the user does not object to the changed terms within four weeks of receiving the change notice, the changed terms shall be deemed accepted. This period will be specifically referred to in the change notice.

  9. Final Provisions

    The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of performance and exclusive place of jurisdiction for all disputes arising from this contract is, to the extent permitted by law, the registered office of CustomWheelers.

    Should any provision of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a valid regulation shall apply that comes closest to the economic purpose of the invalid provision.
